Cambridge Display Technology Limited is the controller responsible for your personal data. We collect and process your personal data whenever you interact with us, including, for instance, when you visit our website, provide the information requested on any form, sign up for any newsletter provided by us, contact or interact with us in relation to the provision of goods or services, apply for jobs and work for us. We are a part of the Sumitomo Chemical group company (“Group”), which is made up of different legal entities, details of which can be found here: www.sumitomo-chem.co.jp/english/company/group. Although we are the controller and responsible for the website, we might share personal data with other Group companies where necessary. Where this takes place, any transfer is covered under our intragroup data transfer agreement, and we remain the controller and fully responsible for the personal data we transfer to other Group companies.

This privacy notice applies to all internal and external stakeholders with whom we interact, including employees, agency workers, suppliers, customers, partners, sponsored third parties, researchers, members of the academia, and members of the public accessing our website or otherwise contacting us.

1. The types of personal data we collect about you

1.1. We may collect, use, store and transfer different kinds of personal data about you, such as Identity (e.g., name, gender, voice, fingerprint, image other personal characteristics), Contact (e.g., email address, home and business addresses, and telephone number, next of kin and their Contact details), Financial (e.g., bank account), Transaction (e.g., products or services you are purchasing and payments details), Technical (e.g., internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, device ID), Profile (e.g., purchases or orders made by you, your interests, preferences, feedback, jobs you apply to, your qualifications and education, disciplinary actions, training history and performance evaluation), Usage (e.g., information about how you interact with and use our website, products or services, and what you search when browsing our website), Communication (e.g., your preferences in receiving marketing from us and our third parties and your communication preferences).

1.2. We may also collect, use and share aggregated data such as statistical or demographic data which is not personal data as it does not directly (or indirectly) reveal your identity (e.g., the aggregate data subjects’ Usage data to calculate the percentage of users accessing a specific website feature in order to analyse general trends in how users are interacting with our website to help improve the website and our service offering).

2. How we collect your personal data

2.1. We use different methods to collect data from and about you. This includes:

2.1.1. Your interactions with us. You may give us your personal data by filling in online forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you contact us or reply to our contact; apply for our products or services; apply to jobs; create an account on our website; subscribe to any service or publications, including newsletters and scientific advisory services; request marketing to be sent to you; enter a competition, promotion or survey; or give us feedback or contact us.

2.1.2. When you interact with our website. We will automatically collect Technical data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. We may also receive Technical data about you if you visit other websites employing our cookies. The cookies that are categorized as strictly necessary are stored in your browser as they are essential for the working of basic functionalities of the website. We also use third-party cookies that help us analyze and understand how you use this website. These cookies will be stored in your browser only with your consent. You also have the option to opt-out of these cookies. But opting out of some of these cookies may affect your browsing experience

2.1.3. From other Group companies, third parties or publicly available sources. We may receive personal data about you from various third parties where you have consented to them providing your personal data to us.

3. How we use your personal data

3.1. We rely on one or more of the following legal bases to collect and process your personal data:

3.1.1. Performance of a contract with you: where we need to perform the contract we are about to enter into or have entered into with you.

3.1.2. Our legitimate interests: we may use your personal data where it is necessary to conduct our business and pursue our legitimate interests, for example to prevent fraud and enable us to give you the best and most secure customer experience. We make sure we consider and balance any potential impact on you and your rights (both positive and negative) before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

3.1.3. Compliance with our legal obligations: we may use your personal data where it is necessary for compliance with a legal obligation that we are subject to. We will identify the relevant legal obligation when we rely on this legal basis.

3.1.4. Your consent: we rely on consent only where we have obtained your active agreement to use your personal data for a specified purpose, for example if you subscribe to an email newsletter.

5. Direct Marketing

5.1. When your personal data is collected, you may be asked to indicate your preferences for receiving direct marketing communications from us if that data is capable of having such a use.

5.2. You may receive related marketing communications from us if you have requested information from us or purchased goods or services from us and you have not opted out of receiving the marketing.

5.3. We may also analyse your Identity, Contact, Technical, Usage and Profile data to form a view of which products, services and offers may be of interest to you so that we can then send you relevant marketing communications.

6. Third-party marketing

6.1. We do not share your personal data with any third party for their own direct marketing purposes, but while using our website or network you might be redirected to or have access to third party website(s) where your personal data might be collected directly by them and in which they are the data controller.

7. Opting out of marketing

7.1. You can ask us to stop sending you marketing communications at any time by contacting us: dataprotection@cdtltd.co.uk

7.2. If you opt out of receiving marketing communications, you will still receive service-related communications that are essential for administrative or customer service purposes (for example, relating to order confirmations for a product or service, updates to our Terms and Conditions, and checking that your contact details are correct).

8. Disclosure of your personal data

8.1. We will never sell your personal data.

8.3. We will need to disclose your personal data to any third party to whom we sell, transfer or merge parts of our business or our assets. Alternatively, we may acquire other businesses or merge with them in which case your personal data will be disclosed to us. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this document.

8.4. We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

9. International Transfer

9.1. Where necessary, we share your personal data with some of our Group companies for the purpose listed above. This will involve transferring your data overseas in our offices located in one of more of the countries where we are based: www.sumitomo-chem.co.jp/english/company/group.

9.2. Whenever we transfer your personal data to countries which have laws that do not provide the same level of data protection as the /English law, we always ensure that a similar degree of protection is afforded to it by ensuring that the following safeguards are implemented. This includes:

9.2.1. All our Group companies adhere to the same set of rules when processing your personal data. This is done via our binding intra-group data transfer agreement;

9.2.2. We use specific standard contractual terms which give the transferred personal data the same protection as it has in the UK.

9.3. We may transfer your personal data to service providers that carry out certain functions on our behalf (e.g., providers of software as a service). This may involve transferring personal data overseas. Whenever we transfer your personal data overseas to service providers, we ensure a similar degree of protection is afforded to your data. We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data. If that is not the case of said country, we may use specific standard contractual terms approved for use by our national regulator which give the transferred personal data the same protection as it has locally.

10. Data security

10.1. We have appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered, disclosed or made inaccessible. We limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

10.2. We have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

11. Data retention

11.1. We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

11.2. To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

11.3. Our default data retention position is that we keep basic information about our customers, suppliers, partners and employees for 6 years after they cease their relationship with us. However certain records are kept for shorter or longer periods as required by legislation or our legitimate business interests.

11.3.1. In relation to employees, Annex 3 of our current Data Privacy Policy provides a more detailed data retention period.

11.3.2. We keep data of unsuccessful job applicants for a period of 12 months after we have informed them (or their recruitment agents) of the unsuccessful outcome of their job candidacy.

11.4. In some circumstances you can ask us to delete your data (see below for further information).

11.5. In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

12. Your legal rights

12.1. You have the right to:

12.1.1. Request access to your personal data (commonly known as a “subject access request”).

12.1.2. Request correction of the personal data that we hold about you.

12.1.3. Request erasure of your personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. We may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

12.1.4. Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) as the legal basis for that particular use of your data (including carrying out profiling based on our legitimate interests). In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your right to object.

12.1.5. Object any time to the processing of your personal data for direct marketing purposes.

12.1.6. Withdraw consent at any time where we are relying on consent to process your personal data. This will not affect the lawfulness of any processing carried out before you withdraw your consent.

12.1.7. Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data if you want us to establish the data’s accuracy, if our use of the data is unlawful but you do not want us to erase it, if you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or if you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

12.2. If you wish to exercise any of the rights set out above, please contact us: dataprotection@cdtltd.co.uk. You do not have to pay a fee to access your personal data or to exercise any of the other rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

12.3. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

12.4. We try to respond to all legitimate requests within one month. Occasionally it could take us longer if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

13. Changes to this document

13.1. We keep this document under regular review and reserve the right to unilaterally change its content without further notice.

14. Your data

14.1. It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us, for example a new address or email address.

15. Third-party links

15.1. Our website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy of every website you visit.
